Armory v Delamirie (1722) 93 ER 664

Facts: Plaintiff (Pl) was a chimney sweeper’s boy who found a jewel and took it to a goldsmith, the defendant (D), for appreciation. The goldsmith’s apprentice received the jewel and took out the stones under the pretence of weighing the piece. The apprentice advised the master the value was three halfpence, but the boy refused the money and demanded the jewel back, which the apprentice returned with the stones removed. Pl brought a claim of conversion.
