Azzopardi v The Queen (2001) 205 CLR 50

Facts: Defendant (D) charged with soliciting X to murder Gauci (V). The prosecution’s (Pr) case relied on X’s evidence, as well as the evidence of 2 further witnesses. D failed to testify the trial judge (TJ) gave a Jones v Dunkel direction that the jury could more readily accept the Pr’s case and more readily make inferences in favour of the Pr where D has failed to testify. TJ said that the jury should note that this itself was not evidence and that there may be legitimate reasons why a D would not testify.
