BA v The King [2023] HCA 14

Facts: The appellant and the complainant were in a domestic relationship. Together, they signed on as co-tenants for an apartment. The relationship broke down, the appellant stopped paying rent and moved out. Later, the appellant returned demanding to be let in but the complainant did not allow entry. The appellant kicked open the door, secured by locks, and proceeded to intimidate and assault the complainant. The appellant was charged with “break and enter”.
