Badenach v Calvert (2016) 257 CLR 440; [2016] HCA 18

Facts: Defendant solicitor instructed by client to prepare will where the entirety of his estate to pass to son-in-law (Calvert) of client’s long-term de facto partner. Client died a year later having executed will drawn up in accordance with instructions. After the client's death, a daughter from previous marriage (for whom he had made no provision in will) brought proceedings under family maintenance legislation; obtained order for provision out of estate. Solicitor had failed to advise the client of the possibility of claim and also the client's options for avoiding such a claim.
