Braysich v The Queen (2011) 243 CLR 434 

Facts: Defendant (D) charged with 25 counts of creating a fake/misleading appearance of active trading in securities under Corporations Act (making himself out to be a stock broker). D relied on statutory defence in s 998 which was that he did not cause sales to take place with the purpose of creating a false and misleading appearance. D did not expressly address defence in testimony but nevertheless raised evidence through 6 witnesses (Ws) who all deposed to his honesty (character evidence).
