Butler v Egg & Egg Pulp Marketing Board (1966) 114 CLR 185

Facts: A marketing initiative formalised by the Marketing of Primary Products Act 1958 (Vic) determined that eggs under the control of egg producers became the property of the Egg & Egg Pulp Marketing Board, the plaintiff (Pl), when they came into existence. The egg producers were entitled to a proportion of the proceeds after Pl had deducted marketing expenses. Ds, instead of delivering the relevant eggs to Pl, sold them to a third party.
