Facts: Defendant (D) was carrying out dredging operations and negligently fractured an underwater pipeline owned by a third party. Pipeline carried oil from the third party headquarters to Caltex Oil, which suffered economic loss when they had to transport petrol by road, which was more expensive. Caltex Oil sued in negligence and sought to recover its loss on expenditure in transportation while pipeline was being repaired.
