Di Napoli v New Beach Apartments [2004] NSWSC 52

Facts: The plaintiff (Pl) and defendant (D) were adjoining occupiers of land. D was constructing a building on its land and placed rock anchors which projected under Pl’s land and were visible in the excavation of D’s land. Pl sought an injunction for removal of rock anchors.
