Hansen v Gloucester Developments [1992] 1 Qd R 14

Facts: The plaintiff (Pl) purchased land from the defendant (D). Pl was aware of construction of roadways but not aware that it would require the removal of part of the surface of Pl’s block. The excavation removed soil and significantly eroded the block. $60,000 was awarded to build a retaining wall to restore the soil levels. D appealed and stated that the damage caused by excavation only reduced the price of the land by $16,000.
