Facts: Defendant (D) (HG), de facto partner of the complainant’s (C) mother, was convicted of sexual offences against a child under 10yo. The acts allegedly took place in C’s bedroom between 1992-93. At the start of the trial, D counsel applied for adjournment to enable him to have a child psychologist (Mr McCombie) available as expert witness (W). W had examined C and prepared a report expressing the opinion that C had not been sexual assaulted by D in 1992-93, but rather, it had been her father 5 years earlier (based on her behaviour changes).
