Hogg v The Queen (2019) 101 NSWLR 524

Facts: Defendant (D) (Hogg) was a baptist minister who was charged with serious indictable offence for sexual intercourse with a minor. D was given a special caution. Acting on legal advice, D declined to answer questions. The grounds of appeal concern the application of s 89A Evidence Act and the directions given to the jury in relation to the drawing of adverse inferences against the accused from his exercise of his right to silence.
