Facts: Defendant (D) (Honeysett) was charged with armed robbery of Narabeen Sands Hotel. There was CCTV footage which showed 3 disguised armed robbers. D’s DNA was found on the hammer, shown in CCTV, however, D argued the DNA could have gotten on it another way. Pr called an expert witness (W) (anatomist) who gave his opinion of the similarities in anatomical characteristics between D and robber in the CCTV (based on viewing the footage and viewing appellant in custody). D was convicted and appealed.
