Jackson v Watson & Sons [1909] 2 KB 193

Facts: The defendants, a firm of grocers, sold tinned salmon to the plaintiff which was unfit for human consumption. As a result of consuming the salmon, the plaintiff and his wife became ill, the wife’s illness being fatal.


Held: In proceedings by the plaintiff to recover damages for breach of implied warranty in the contract for the sale of the tinned salmon, the Court of Appeal upheld an award of damages in favour of the plaintiff for medical and funeral expenses incurred as a result of his wife’s illness and death as well as the cost of replacing the household and family services which had been provided by the deceased wife.
