Khamis v The Queen [2010] NSWCCA 179 

Facts: The complainant (C) had confided in the girlfriend of her brother in the morning after she had been sexual assaulted by the defendant (D) (the appellant). D tried to adduce evidence of a conversation he had with C indicating no sexual intercourse had taken place and the acts of intimacy had been consensual. D’s version of events had not been put in cross-examination (CE) of the complainant nor of any member of her family. The trial judge excluded the D’s evidence.
