Kuwait Airways Corp v Iraqi Airways Co (Nos 4 and 5) [2002] 2 AC 883

Facts: Iraqi forces invaded Kuwait in 1990 and seized 10 commercial aircraft owned by Kuwait Airways Corp, the plaintiff (Pl). The Iraq government instructed Iraqi Airways Corp, the defendant (D), to transport the aircraft to Iraq and incorporate them into its own fleet. D used and insured the aircraft and repainted them with D’s colours and logos.
