L Shaddock & Associates v Parramatta City Council (1981) 150 CLR 225

Facts: Shaddock (plaintiff; Pl) wanted to buy land in Parramatta and build a high rise. He was concerned about road-widening proposals. His solicitor phoned Parramatta Council and spoke with someone who indicated that there were no such proposals for the land. Pl entered into the contract to buy the land. Pl’s solicitors then sent a formal written enquiry to the Council and the Council sent back a statutory form leaving the question about road-widening proposals blank. Pl bought the land and found out that there was a road-widening proposal. Pl would not have gone ahead if he knew. P lost substantial profit in the development.
