LJW v R [2010] NSWCCA 114

Facts: The defendant (D) was charged with child sexual assault (anal intercourse and fellatio) of child who was accompanying him on a trip. There was evidence of other incidents en route that day and on the trip (e.g. masturbating while driving, skinny dipping and other inappropriate behaviour). The prosecution (Pr) wanted to adduce evidence that D didn’t have proper boundaries around his sexual behaviour in the presence of 12 year old boys.
