Loulach Developments v Roads and Maritime Services [2019] NSWSC 438

Facts: Loulach Developments, a developer, applied to local council for consent to develop two lots of land. Council were required to consult Roads and Maritime Services (RMS) who would consider impact on traffic. RMS, mistakenly, advised there was a road widening proposal for one of the lots when there was not.  Loulach Developments suffered $5 million ‘loss’.
