May v O'Sullivan (1955) 92 CLR 654

Facts: Defendant (D) (May) was convicted on 2 charges related to betting at a hotel. If D's evidence had been believed, it would establish that he was not present when all but one of the alleged bets were made, and with regard to that one bet, serious doubt would have been cast on the evidence of the prosecution (Pr) that the convictions would not have been justifiable.
