Munro v The Queen [2014] ACTCA 11

Facts: Defendant (D) was tried for robbing a security van. There was DNA evidence from a cigarette stub collected from the spot near the crime scene (where robbers were waiting for a getaway van to arrive). Prosecution (Pr) had to prove where the cigarette stub was found, wishing to rely on evidence from a cleaner. The cleaner died before trial (unavailable).
