Nguyen v R (2020) 269 CLR 299

Facts: The appellant/defendant (D) (Nguyen) was charged on indictment with offences against the Criminal Code (NT) and stood trial before a jury in NT Supreme Court, governed by the Evidence (National Uniform Legislation) Act 2011 (NT). He had been interviewed by police prior to being charged. The interview was recorded electronically and the recording contained statements by him which contained both admissions and exculpatory statements (i.e. ‘mixed statements). The prosecution (Pr) did not lead evidence of the exculpatory statements.
