Parramatta City Council v Lutz (1988) 12 NSWLR 293

Facts: Mrs Lutz, the plaintiff (Pl), lived in a weatherboard cottage she owned. Pl was concerned about a fire risk on the abandoned property next door. Pl went to the Parramatta City Council, the defendant (D), several times to draw their attention to the issue. Her house was destroyed in a fire that began on the derelict property next door. Pl brought an action for negligence.
