Pate v The Queen [2015] VSCA 110

Facts: Defendant (D) (uncle) allegedly exposed himself and touched the complainant (C) (his niece) in different ways. He lived at the same property and gave her dance lessons after school at his house. The prosecution’s (Pr) case consisted of C’s evidence and evidence of C’s complaint to her boyfriend and mother. D denied the allegations and gave evidence. There had been a 12 year delay in the events until she had told her boyfriend and then the police.
