Public Transport Commission of NSW v Perry (1977) 137 CLR 107

Facts: A woman fell onto train tracks due to an epileptic fit. The train didn’t stop in time and injured her. She sued the Public Transport Commission for the driver’s negligence in not stopping. The Public Transport Commission denied liability by claiming she was trespassing and therefore, they owed her no duty of care.
