R v GW (2016) 258 CLR 108

Facts: Defendant (D) (GW) was convicted of an act of indecency in the presence of a child under 10yo (daughter was allegedly 5yo at time of offence and 6yo at trial). Following a voir dire hearing, the trial judge (TJ) determined the child's evidence should be received unsworn.
