R v Ngo (2001) 122 A Crim R 467

Facts: Defendant (D) (Ngo, and others) charged with murder of a politician (Newman). Prosecution (Pr) preempted an attack on credibility so they wished to lead evidence in evidence-in-chief (EIC) from 2 accomplice witnesses (Ws) (who had been given indemnities) re when they first went to authorities, why they did & why they did not disclose all material information at the time. At the voir dire, it was objected that this evidence was prohibited under s 102 Evidence Act as only going to the credibility.
