R v Zhang [2000] NSWSC 1099

Facts: Zhang (Defendant; D) on trial for 2 counts of murder. D was interviewed for the purpose of taking a witness statement and determining whether he was suitable for witness protection. During the interview, he admitted guilt. He was then interviewed again, this time recorded electronically. He accompanied police to the scene and demonstrated what happened. The police then recorded another interview. He was offered witness protection but only if he cooperated; otherwise he would be charged with murder. He was told that he would get a reduced or no sentence if he cooperated. There was also a threat of physical violence – the detective said he would like to hit him in the face. He was told that once the detective left the room, there would be no further opportunity to cooperate.
