Robinson v Woolworths (2005) ACrimR 546

Facts: Department of Health (Robinson) procured minors to go undercover to purchase cigarettes to investigate compliance of retailers (Woolworths) with law prohibiting supplying cigarettes to minors. Woolworths objected on the basis that it was entrapment (the minors begged & told the shopkeeper they would get beaten by their relative if they didn't buy cigarettes for him). The trial judge (TJ) found that the evidence was obtained improperly under s 138 Evidence Act and excluded it.
