Rodrigues v Ufton (1894) 20 VLR 539

Facts: The plaintiff (Pl) owned a property which was in possession and occupation by tenants. Defendant (D) was the owner of an adjoining property and disputed title to a strip of land in the backyard. D entered the plaintiff’s property, destroyed the existing fence, and erected a new fence excluding access to the disputed strip of land.
