St Helen's Smelting Co v Tipping (1865) 11 ER 1483

Facts: The plaintiff (Pl) purchased a house near the defendant’s (D) copper smelting property which Pl was aware of. Noxious fumes from D’s factory caused damage to trees and crops on Pl’s land. Pl sued for nuisance.
