Tuite v The Queen (2015) 49 VR 196

Facts: Defendant (D) was charged with aggravated burglary, Sexual assault, indecent assault and intentionally causing injury. Expert evidence was to be called about the analysis of DNA samples from the crime scene, and the DNA sample provided by D following an unrelated conviction. DNA evidence was presented in the usual form of a “likelihood ratio”. However, the software used/methodology was largely untested and had not been generally accepted by the forensic science community. As a result, it was argued that it should be excluded as unreliable.
