Velevski v The Queen (2002) 76 ALJR 402

Facts: Defendant (D) was charged with the murder of wife and 3 kids. D argued that his wife killed the kids and then committed suicide by cutting her own throat (i.e. murder-suicide). There was no trace of blood connected to D. Various expert witnesses (W) were called but they disagreed over whether the wife’s wounds were self-inflicted. The prosecution (Pr) called 4 expert Ws for the murder-murder theory and only 1 expert W (Dr Bradhurst; who agreed with D’s W, Dr Zillman) for the murder-suicide theory. In addition, the detective who conducted the investigation said the opinion of Dr Bradhurst was shared by some of his colleagues, but the detective did not obtain statements from these colleagues.
